The UDRP case regarding YPLAN.COM


 

Makers Of YPlan App Found Guilty Of Reverse Domain Name Highjacking on 14 Year old domain name YPLAN.com.

 
Yplan Inc., represented by Eugene Rome of Rome & Associates, A.P.C., California, USA loses UDRP case in its attempt to unfairly grab 14 year old YPLAN.com domain name.

The Panelist found Yplan Inc. guilty of Reverse Domain Name Hijacking.
  The domain holder registered the domain name YPLAN.com back in 2001. The Complainant's company was not even formed until January 30, 2013.

The panelist found that the YPLAN.com domain name had neither been registered in bad faith nor was the YPLAN.com domain name being used in bad faith.

  The WIPO Panelist stated:
"Complainant should have realized that there was no way to prevail on this Complaint."

Yplan Inc.represented by Eugene Rome of Rome & Associates, A.P.C., California, USA had their complaint denied.

The panelist's concluding paragraph sums up by saying:

"Under these circumstances, pursuant to Rule 15(e), the Panel finds that the Complaint was brought in bad faith primarily to deprive a registered domain-name holder of a domain name and constitutes an abuse of the administrative proceeding."

There are numerous sources for "Reverse Domain Name Hijacking".  Amongst these are RDNH.com and HallOfShame.com (which includes a current list of those found guilty of trying to Reverse Hijack a Domain Name in which they had no legal rights. In other words they tried to bully the rightful owners into relinquishing their property and forcing these innocent parties to spend thousands to defend what they already own).
